POP-IN PHOTOGRAPHY — NEW BOOKINGS
When the service summary specifies the $95 Pop-In Photography package, the flat, all-inclusive total covers preparation and equipment, client communication and scheduling, round-trip travel to the eligible location, up to 30 minutes of photography, image review, culling and selection, professional editing and post-processing, and digital delivery of 10 finished photographs. The 13% booking retainer is $12.35, applied toward the $95 total, leaving $82.65 due upon completion of scheduled on-site services unless agreed otherwise in writing.
The agreed location must be within a strict five-mile radius of 7306 Blue Ash Road, Deer Park, Ohio. Locations outside this radius are ineligible for this package; no automatic travel surcharge applies. No separate travel, editing, processing, equipment, or administrative charges apply to the included package services. For this package, these terms take precedence over the general travel-cost wording in Section 4 and the general gallery-quantity wording in Section 5. The final deliverable commitment is 10 professionally edited digital photographs selected by Photographer, rather than all usable captures.
Pop-In is a complete professional service designed for brief coverage and a focused gallery, distinct from the standard one-hour session. These new-booking terms do not retroactively change any existing client's agreed price, contract, retainer, payment link, deliverables, or original booking arrangements.
AGREED TERMS
1. Booking Retainer & Reservation of Date
A booking retainer equal to 13% of the estimated service total is required to reserve the scheduled date and time. The booking retainer will be applied toward the client's final balance. The remaining balance is due upon completion of the scheduled on-site services unless otherwise agreed to in writing. A date is not considered officially reserved until this Photography Services Agreement has been completed and the booking retainer has been received. The booking retainer is nonrefundable except if Photographer cancels or as required by law. Additional approved coverage is $195 per hour unless stated otherwise in writing.
2. Services and cooperation
Photographer will provide the photography and/or video services identified in the completed service summary. Videography and a second photographer are not included unless they are specifically included in the completed service summary or otherwise agreed to in writing before the session.
Client will provide accurate schedules, contacts, access, venue rules, and needed permissions. No particular pose, person, expression, or moment can be guaranteed.
3. Cancellation and rescheduling
Client cancellation must be emailed to info@mattmouserfineart.com. Amounts paid above the retainer are refundable for cancellation more than 30 days before service, less approved nonrecoverable expenses. One request made at least 14 days before service may transfer the retainer to a mutually available date within 12 months. Later requests may be treated as cancellation.
4. Travel and safety
Client pays travel, lodging, transportation, baggage, permit, parking, toll, and venue expenses approved in writing. Destination travel costs may be due in advance and remain nonrecoverable. Photographer may stop coverage if conditions are unlawful, unsafe, threatening, or damaging to equipment.
5. Deliverables, Culling & Creative Discretion
Not every photograph or video clip captured during a session will necessarily be usable or delivered. A normal session may include test shots, duplicate images, missed focus, blinking or unflattering expressions, accidental captures, exposure tests, camera movement, unusable audio or video, technical failures, or other material that does not meet Photographer's professional standards.
Client will receive all successful and usable final material from the session—not every photograph, shutter click, video clip, test shot, or file created during the session. Photographer uses professional and artistic judgment to select, cull, edit, organize, and deliver the strongest usable photographs and video material, with the intention of providing as much strong, successful material as possible while excluding test, duplicate, technically unsuccessful, or otherwise unusable captures.
Photographer does not intentionally withhold successful photographs or usable footage that meet the standards for final delivery.
When photography and video are both included, Photographer may use multiple cameras, phones, tablets, or other recording devices. When video is included, Photographer will review all available usable footage and select the strongest clips to create the agreed finished video. Not every recorded clip is guaranteed to appear in the finished video. Where an approximate length or format has been agreed upon, such as an approximately one-minute video for Instagram Reels, Facebook Reels, Stories, or similar social-media use, the final edit will be created with that intended length and format in mind.
Raw files, unedited files, test images, duplicate photographs, rejected images, technically unsuccessful images, unusable video clips, and unused footage are not included in the Client’s final delivery unless specifically agreed upon in writing before the session.
References to “all photos,” “all photographs,” “everything from the shoot,” or similar wording mean all successful and usable final material, not literally every file captured by a camera or recording device.
Photography and videography involve changing lighting, movement, expressions, equipment, environments, timing, and other variables. Individual photographs or clips may occasionally be unsuccessful even when reasonable professional care is taken. Technical or environmental circumstances may occasionally affect individual photographs, video clips, or audio recordings. Photographer's responsibility is to use the successful material captured during the session to create the strongest possible finished collection for Client's benefit. Photographer retains professional and creative discretion regarding which captures meet the standard for final delivery and how successful material is edited and assembled.
Client acknowledges having had the opportunity to review Photographer’s work and accepts Photographer’s professional and artistic judgment regarding composition, lighting, posing, image selection, color, cropping, editing, sequencing, and assembly.
6. Delivery and completion
Estimated delivery is 6-8 weeks for weddings and destination weddings and 2-4 weeks for other sessions, unless written otherwise. On-site photography and videography services are completed at the end of the scheduled coverage period. Editing, culling, organization, and final delivery occur afterward. The edited gallery is delivered afterward within the estimated timeframe above. Client will promptly download and back up files; online galleries may be removed 90 days after delivery.
When video is specifically included, the finished video will be edited from the strongest usable footage and delivered in the approximate length, format, style, and timeframe agreed to in writing.
7. Copyright and client use
Photographer retains copyright. After full payment, Client receives a nonexclusive personal-use license to download, share, and display delivered photographs and video, and to make personal prints from delivered photographs. Client may not sell, commercially publish, materially alter, apply filters to, or remove watermarks without written permission.
8. Photographer inability to perform
Because this is a one-person business, a substitute is not guaranteed. If serious illness, emergency, equipment loss, travel disruption, or another event beyond reasonable control prevents performance and no acceptable alternative is available, Photographer will refund amounts paid for unperformed services, including the retainer.
9. Liability
To the fullest extent permitted by law, Photographer's total liability will not exceed the amount Client paid under this agreement. If images are lost, corrupted, stolen, or destroyed despite reasonable care, the remedy is limited to a refund proportionate to the affected services, up to the amount paid.
10. Complete agreement and electronic acceptance
Ohio law governs. This document and its completed summary are the entire agreement; changes must be accepted in writing by both parties. A typed name, checked acceptance box, or electronic submission intended as a signature has the same effect as a handwritten signature to the extent allowed by law.
SEPARATE PORTFOLIO / MARKETING PERMISSION — SELECT ONE
YES - selected images may be used on the website, social media, in exhibitions, and for promotion.
NO - no portfolio or marketing use. This choice does not affect services.
